IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THIS WEBSITE, JOINING A LAUNCH LIST, CREATING AN ACCOUNT, OR PURCHASING OR ACCESSING ANY DIGITAL PRODUCT.

These Terms and Conditions (the “Terms”) form a binding agreement between you and INCIDAGI LLC, a Florida limited liability company operating the Başarı Doktoru digital education brand (“Başarı Doktoru,” “we,” “us,” or “our”). These Terms govern your access to and use of https://www.basaridoktoru.com, any related pages or funnels that link to these Terms (collectively, the “Website”), and any digital courses, videos, downloads, educational materials, emails, or other products and services we make available through the Website (collectively, the “Services”).

By using the Website, submitting a form, joining a launch or enrollment list, creating an account, or completing a purchase, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Website or Services.

1. ELIGIBILITY

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a purchase or enter into a binding agreement with us. A person below the age of legal majority may use the Services only with the knowledge, supervision, and consent of a parent or legal guardian who agrees to these Terms on that person’s behalf.

2. ABOUT OUR SERVICES

Başarı Doktoru develops and sells digital educational products, including online courses and downloadable learning materials focused on energy management, productivity, effective learning, and personal development.

Our current flagship product is a Turkish-language, on-demand digital course currently presented as “The 14-Day Energy System” and/or “Enerjinizi 10X Yapın ve Sürdürün.” Product names, curriculum, pricing, availability, access periods, and included materials may change or be updated from time to time.

Unless expressly stated otherwise, our products are digital. No physical product will be shipped.

3. PRE-LAUNCH AND LAUNCH LISTS

Some pages may be available before paid enrollment or online payment is active. If you join a launch list or submit an interest form:

·         you are not placing an order;

·         you are not authorizing a payment;

·         no subscription is created;

·         no payment information is collected by us through that form; and

·         you may receive launch, enrollment, and related marketing information by email if you consent.

You may unsubscribe from marketing emails at any time by using the unsubscribe link in the email or contacting us.

4. ACCOUNTS, ACCESS, AND SECURITY

You may be required to create an account or use a unique access link to view purchased course content. You agree to provide accurate and current information and to keep your login credentials confidential.

Your account and course access are for your personal use only. You may not share, sell, transfer, sublicense, publish, or distribute your login details or course access to another person.

You are responsible for activity occurring through your account unless you promptly notify us of unauthorized access. Contact us at support@basaridoktoru.com if you believe your account or access credentials have been compromised.

5. ORDERS, PRICES, AND PAYMENT

When paid enrollment becomes available, the price, currency, payment type, product description, and access period will be shown on the applicable sales or checkout page before purchase.

Unless the checkout page expressly states otherwise:

·         purchases are one-time payments, not recurring subscriptions;

·         prices are displayed in U.S. dollars;

·         payment must be successfully authorized before an order is accepted; and

·         we may use a third-party payment processor to process the transaction.

An automated confirmation does not prevent us from cancelling or refunding an order if payment is unsuccessful, pricing is clearly incorrect, fraud is suspected, required information is missing, or the product is unavailable.

You are responsible for providing accurate billing and contact information. Any taxes, currency conversion charges, or bank fees imposed by your payment provider or jurisdiction are your responsibility unless applicable law requires otherwise.

6. DIGITAL DELIVERY AND ACCESS

After a successful purchase, access instructions will normally be delivered by email or made available through the course platform. Delivery times may be affected by payment confirmation, technical issues, spam filters, incorrect email addresses, or third-party service interruptions.

If you do not receive access within the time stated on the checkout or confirmation page, contact support@basaridoktoru.com using the email address associated with the purchase.

Your access period will be stated on the product page or checkout page. “Lifetime access,” if offered, means access for as long as we continue to operate and make that product available, and does not mean the lifetime of any individual or guarantee permanent hosting on a specific platform.

7. REFUNDS

Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference. Our standard policy for the applicable digital course is a seven-calendar-day refund period beginning on the purchase date, subject to the conditions described in the Refund Policy.

Nothing in these Terms limits any consumer right that cannot legally be waived.

8. LICENSE AND INTELLECTUAL PROPERTY

The Website and Services, including all videos, text, course materials, worksheets, graphics, logos, trademarks, photographs, audio, designs, downloads, methods, and other content, are owned by or licensed to INCIDAGI LLC and are protected by applicable intellectual-property laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use purchased course materials solely for your personal, non-commercial educational use during the applicable access period.

You may not, without our prior written permission:

·         copy, record, reproduce, republish, upload, distribute, transmit, translate, modify, sell, license, or create derivative works from the Website or Services;

·         share course videos, files, screenshots, worksheets, or account access with another person;

·         use the content to create or train a competing course, product, database, artificial-intelligence system, or commercial service;

·         remove copyright, trademark, attribution, or proprietary notices; or

·         scrape, crawl, reverse engineer, interfere with, or attempt unauthorized access to the Website, platform, or systems.

9. ACCEPTABLE USE

You agree not to use the Website or Services to:

·         violate any law or the rights of another person;

·         submit false, fraudulent, misleading, or impersonating information;

·         introduce malware, harmful code, automated abuse, or excessive technical load;

·         harass, threaten, discriminate against, or unlawfully interfere with another person;

·         attempt to bypass payment, access, security, or usage restrictions; or

·         engage in chargeback abuse, refund fraud, or unauthorized distribution of content.

We may suspend or terminate access if we reasonably believe these Terms have been violated.

10. EDUCATIONAL AND HEALTH DISCLAIMER

11. NO GUARANTEED RESULTS

Individual results vary. Product names or marketing phrases such as “10X Energy” describe the theme or positioning of a program and do not constitute a literal, mathematical, clinical, academic, financial, or performance guarantee.

We do not guarantee any specific improvement in energy, focus, productivity, academic performance, health, income, habits, relationships, or personal outcomes. Your results may depend on health status, personal circumstances, prior knowledge, effort, consistency, environment, and factors outside our control.

12. TESTIMONIALS, REVIEWS, AND USER SUBMISSIONS

If you voluntarily submit a review, testimonial, comment, image, success story, or other material, you represent that it is truthful, based on your genuine experience, and does not violate another person’s rights.

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, edit for length or clarity, publish, and display the submission in connection with our business and marketing, unless we agree otherwise in writing. We will not materially alter the meaning of a testimonial.

Testimonials describe individual experiences and are not guarantees that another person will obtain the same result.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCIDAGI LLC, ITS OWNER, CONTRACTORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST OPPORTUNITY, OR THE COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE WEBSITE, SERVICES, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

17. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless INCIDAGI LLC, its owner, contractors, service providers, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Website or Services, your violation of these Terms, your infringement of another person’s rights, or content you submit.

18. SUSPENSION AND TERMINATION

We may suspend or terminate access to the Website or Services if you materially violate these Terms, engage in fraud or abuse, share course access, infringe intellectual property, threaten platform security, or fail to pay an amount lawfully due.

Termination does not affect provisions that by their nature should survive, including intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions.

19. INFORMAL DISPUTE RESOLUTION

Before filing a legal claim, you agree to contact us at support@basaridoktoru.com and provide a reasonable description of the dispute and the requested resolution. We will attempt in good faith to resolve the issue informally.

This section does not prevent either party from seeking urgent injunctive relief to protect intellectual property, confidential information, security, or prevent imminent harm.

20. GOVERNING LAW AND VENUE

These Terms and any dispute arising from them are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent mandatory consumer law in your jurisdiction applies.

Subject to any non-waivable consumer rights, the state and federal courts located in Pinellas County, Florida will have exclusive jurisdiction over disputes that are not resolved informally.

21. ELECTRONIC COMMUNICATIONS AND SIGNATURES

When you use the Website, submit a form, click an acceptance checkbox, create an account, or complete a purchase, you consent to receive agreements, notices, confirmations, and other communications electronically. Electronic actions and records may have the same legal effect as paper documents and handwritten signatures where permitted by law.

22. FORCE MAJEURE

24. SEVERABILITY AND NO WAIVER

Our failure to enforce a provision is not a waiver of that provision or any other right.

25. CHANGES TO THESE TERMS

We may update these Terms from time to time by posting a revised version on the Website and changing the Effective Date. Material changes may also be communicated by email or a notice on the Website where appropriate.

Your continued use of the Website or Services after the revised Terms become effective constitutes acceptance of the revised Terms, except where applicable law requires additional consent.

26. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Refund Policy, product-specific checkout disclosures, and any other policy expressly incorporated by reference, form the entire agreement between you and us regarding the Website and Services and supersede prior communications on the same subject.
